PUBLIC OFFER AND USER AGREEMENT

1. General Provisions

1.1. This document constitutes an official offer (Public Offer) of the owner of the TORNADO online store to conclude a distance sales agreement in accordance with the Civil Code of Ukraine, the Commercial Code of Ukraine, and the Law of Ukraine "On Electronic Commerce".

1.2. Placing an order on the website constitutes the Buyer's full and unconditional acceptance of the terms of this Public Offer and User Agreement.

1.3. The website administration reserves the right to amend this Offer without prior notice. The current version is always available on the website.

1.4. The online store sells workwear, footwear, tactical equipment, accessories, and other products presented on the website.

1. Terms and Definitions

For the purposes of this Offer, the following terms shall have the meanings set forth below:

• Website — the TORNADO online store website.
  • Seller — the entity selling products through the Website.
  • Buyer — an individual or legal entity that places an order for products.
  • Product — goods offered for sale on the Website.
  • Order — a properly submitted request by the Buyer to purchase a Product.

1. Subject Matter of the Agreement

3.1. The Seller undertakes to transfer ownership of the Product to the Buyer, and the Buyer undertakes to pay for and accept the Product under the terms of this Offer.

3.2. Product specifications, descriptions, prices, and other information are published on the Website.

3.3. Product photographs are illustrative and may differ slightly from the actual appearance of the Product.

1. Registration and Use of the Website

4.1. The User undertakes to provide accurate information when placing an Order.

4.2. The following actions are prohibited:

• using the Website in violation of applicable laws;
  • providing false information;
  • performing actions that may disrupt the operation of the Website;
  • distributing malicious software;
  • attempting unauthorized access to the Website's information systems.

4.3. The Website administration reserves the right to restrict access to the Website in the event of a violation of this Agreement.

1. Placing an Order

5.1. Orders may be placed through the Website, email, messaging applications, or by telephone.

5.2. After an Order is placed, a Seller's representative may contact the Buyer to clarify the details.

5.3. An Order is considered accepted for processing upon confirmation by the Seller.

5.4. The Seller reserves the right to refuse fulfillment of an Order in the following cases:

• the Product is unavailable;
  • the Buyer has provided inaccurate information;
  • it is impossible to contact the Buyer to confirm the Order.

1. Prices and Payment Terms

6.1. All prices on the Website are indicated in Ukrainian Hryvnia (UAH), unless otherwise specified.

6.2. The Seller reserves the right to change prices without prior notice.

6.3. The Product price for the Buyer is fixed at the time the Order is confirmed.

6.4. Payment may be made using the methods available on the Website, including:

• bank card payment;
  • bank transfer;
  • cash on delivery;
  • other methods specified on the Website.

1. Delivery

7.1. Delivery is available within Ukraine and to other countries in accordance with the conditions specified on the Website.

7.2. Delivery times depend on the selected delivery method and the carrier's performance.

7.3. The risk of accidental loss or damage to the Product passes to the Buyer upon transfer of the Product to the carrier or upon receipt of the Product by the Buyer.

1. Returns and Exchanges

8.1. Returns and exchanges shall be carried out in accordance with the applicable laws of Ukraine.

8.2. The Buyer has the right to return a Product of proper quality within 14 calendar days from the date of receipt, provided that the Product's appearance, packaging, labels, and accompanying documents are preserved.

8.3. Products that are not subject to return or exchange under Ukrainian law cannot be returned.

8.4. The cost of returning a Product shall be borne by the Buyer unless otherwise required by law or agreed between the parties.

1. Rights and Obligations of the Parties

The Seller has the right to:

• modify the assortment of Products;
  • change prices;
  • conduct promotions and special offers;
  • refuse service in cases of violation of this Agreement.

The Seller undertakes to:

• provide accurate Product information;
  • fulfill confirmed Orders;
  • ensure the protection of personal data in accordance with applicable law.

The Buyer has the right to:

• receive information about Products;
  • require proper fulfillment of Orders;
  • return or exchange Products in accordance with the law.

The Buyer undertakes to:

• provide accurate information;
  • pay for Orders in a timely manner;
  • comply with the terms of this Offer.

1. Intellectual Property

10.1. All texts, photographs, logos, trademarks, graphic elements, and other materials published on the Website are protected by intellectual property laws.

10.2. Any use of Website materials without the prior written consent of the rights holder is prohibited, except as permitted by applicable law.

1. Liability

11.1. The Parties shall be liable in accordance with the applicable laws of Ukraine.

11.2. The Seller shall not be liable for:

• delivery delays caused by carriers;
  • interruptions in Internet services;
  • actions of third parties;
  • inaccuracies resulting from errors made by the User when placing an Order.

11.3. The Seller's maximum liability shall be limited to the actual value of the purchased Product.

1. Force Majeure

12.1. The Parties shall be released from liability for failure to perform their obligations due to force majeure circumstances, including military actions, states of emergency, fires, natural disasters, communication failures, decisions of governmental authorities, and other circumstances beyond the Parties' reasonable control.

1. Personal Data

13.1. By placing an Order, the User consents to the processing of personal data in accordance with the Privacy Policy published on the Website.

13.2. Personal data shall be processed solely for the purposes of fulfilling Orders, operating the Website, and complying with legal requirements.

1. Dispute Resolution

14.1. The Parties shall endeavor to resolve any disputes and disagreements through negotiations.

14.2. If no agreement can be reached, the dispute shall be resolved in accordance with the applicable laws of Ukraine.

1. Final Provisions

15.1. This Public Offer becomes effective upon its publication on the Website.

15.2. The invalidity of any provision of this Offer shall not affect the validity of the remaining provisions.

15.3. The User confirms that they have read, understood, and fully accepted the terms of this Offer.
